01Agreement to these Terms

These Terms of Use (the “Terms”) form a binding agreement between you and ScamMinder AI Trust LLC (“PowerSEC,” “we,” “us,” or “our”) regarding access to and use of the PowerSEC website, the PowerSEC WordPress plugin, and the PowerSEC Central dashboard (collectively, the “Service”).

By creating an account or using the Service, you accept these Terms. If you are creating an account on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

02What the Service does

PowerSEC provides security tooling for WordPress site owners — including security monitoring, malware and website-indicator scans, vulnerability and rule checks, backups, alerts, and remote actions issued from a central dashboard. Specific features available to your account depend on your subscription plan and configuration.

03Account responsibilities

You are responsible for the accuracy of the information you provide, for safeguarding your account credentials, and for all activity that occurs under your account — whether performed by you, by people you invite, or by automation you connect.

Notify us promptly at info@powersec.io if you suspect unauthorized access. You may not share a single account among multiple individuals — use team invitations instead.

04Sites you connect

You may only connect WordPress sites that you own or have explicit authorization to manage. By connecting a site, you confirm that you have the right to install the PowerSEC plugin, transmit telemetry, run scans, perform backups, and execute remote actions on that site.

You remain responsible for compliance with the privacy policies, contractual commitments, and laws that apply to those sites.

05Acceptable use

You agree not to use the Service to:

• violate any law or the rights of any third party;
• access systems, accounts, or data without authorization;
• distribute malware, webshells, or other harmful code;
• attack, probe, or attempt to disrupt third-party sites or networks;
• interfere with the Service, including by abusing rate limits or APIs;
• reverse engineer, decompile, or attempt to extract source code from non-public parts of the Service, except as expressly permitted by law;
• misrepresent your identity, impersonate another person, or use the Service to send unsolicited commercial messages; or
• resell or sublicense the Service without our written agreement.

We may suspend or terminate access for activity that we reasonably believe violates these rules.

06Security and availability — important limitations

You remain responsible for your sites’ security posture, including patching, access control, hardening, monitoring, and incident response. We do not warrant that the Service will identify every threat or prevent every attack.

07Backups

The Service includes optional backup features. Backups are subject to your configuration, the storage destination you choose, available disk and network capacity, and the cooperation of the underlying WordPress site.

You are responsible for verifying your backups, testing restores, and maintaining independent off-site copies of critical data. We are not liable for backup failures or data loss caused by misconfiguration, third-party storage, or factors outside our reasonable control.

08Plans, billing, and renewals

PowerSEC uses a per-site billing model. Each connected WordPress site may be individually upgraded to a paid package.

Storage and restore-point limits apply per the package in effect at the time of each backup. Once a site is paid, charges are disclosed at checkout and in your account billing area. Subscriptions auto-renew at the end of each billing period using your payment method on file unless cancelled in advance. Taxes may apply.

Payment is processed by a third-party payment processor under its own terms. We do not store full payment card numbers. We may change pricing or plan features prospectively; if we do, we will use reasonable efforts to notify active subscribers in advance.

09Cancellation and refunds

You may cancel a paid subscription at any time from your account billing area or by contacting us. Cancellation takes effect at the end of the current billing period; you retain access to paid features through that date.

Except where required by law or stated in a separate written agreement, fees already paid are non-refundable. If a payment fails, we may suspend access to paid features until billing is restored.

10Intellectual property

The Service, including the PowerSEC name, logo, software, content, and design, is owned by ScamMinder AI Trust LLC and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

You retain ownership of the data you submit; you grant us a worldwide license to host, process, and transmit that data solely as needed to provide and improve the Service. Feedback you send us about the Service is non-confidential, and you grant us a royalty-free license to use it without obligation to you.

11Third-party services and content

The Service may interoperate with third-party services (for example, payment processors, S3-compatible storage, email or messaging providers, vulnerability data feeds). Your use of those services is governed by their own terms. We do not control and are not responsible for the availability, accuracy, or behavior of third-party services or content surfaced through them.

12Disclaimers

To the maximum extent permitted by applicable law, ScamMinder AI Trust LLC disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, or fully secure, or that defects will be corrected.

13Limitation of liability

To the maximum extent permitted by applicable law, ScamMinder AI Trust LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or relating to the Service, even if advised of the possibility of such damages.

Our aggregate liability for all claims relating to the Service in any twelve-month period will not exceed the greater of (a) the amounts you paid us for the Service in that period, or (b) one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so portions of these limits may not apply to you.

14Your indemnity

You agree to defend, indemnify, and hold harmless ScamMinder AI Trust LLC from claims, damages, costs, and expenses (including reasonable attorneys’ fees) arising from (i) your use of the Service in violation of these Terms or applicable law, (ii) content, sites, or data you connect to the Service, or (iii) your violation of any third-party rights.

15Termination

You may stop using the Service at any time. We may suspend or terminate access — in whole or in part — if we reasonably believe you have violated these Terms, if your use creates a security or legal risk, or if continued operation becomes commercially impracticable. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, liability limits, indemnity, and governing law) will survive.

16Changes to the Terms or the Service

We may update these Terms from time to time. When we make material changes, we will update the “Effective date” above and, where appropriate, notify account holders by email or in-product message. Your continued use of the Service after the changes take effect means you accept the updated Terms. We may also add, modify, or remove features over time.

17Governing law and disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be brought exclusively in the state or federal courts located in Florida, and you and PowerSEC consent to personal jurisdiction in those courts. Nothing in this section prevents either party from seeking injunctive or equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information.

18Miscellaneous

These Terms, together with the Privacy Policy and any plan-specific terms presented at checkout, are the entire agreement between you and ScamMinder AI Trust LLC regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a right is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
